All users who register with our site agree they will not copy or emulate our business model, methods, patterns, techniques, formulas, html, php, code, or otherwise duplicate our copyrighted and patented materials, content, and methods, which actions may violate laws that protect the intellectual property owned, created, or registered by School Of Liberty. Your School of Liberty membership consists solely of admission to our subscription service to access our private content, which may start with a free trial, and will continue month-to-month and automatically renew unless and until you cancel your membership or we terminate it. You must have functional internet access and provide us with a current, valid, accepted method of payment (as such may be updated from time to time, "Payment Method") to use the School of Liberty service. We will bill the monthly membership fee to your Payment Method. You must cancel your membership before it renews each month in order to avoid billing of the next month's membership fees to your Payment Method. Other Memberships. We may offer a number of other membership plans, including special promotional plans or memberships with different lengths, conditions and limitations. Any materially different terms from those described in these Terms will be disclosed at your sign-up or in other communications made available to you. You may learn about specific details regarding your membership with School of Liberty by visiting our website and clicking on the "Members Login" link, or if you have specific questions please email us at (support at schoolofliberty dot org). Some promotional memberships are offered by third parties in conjunction with the provision of their own products and services. We are not responsible for the products and services offered or provided by such third parties. We reserve the right to terminate, modify, or otherwise change our own offered memberships. Free Trial: Your School of Liberty membership may start with a free trial. This free trial period of your membership lasts for seven days, or as otherwise specified during sign-up. When combined other offers, restrictions may apply. Free trials are for new and certain former members only. School of Liberty reserves the right, in our discretion, to determine if you are eligible for any free trial. We will automatically bill your Payment Method for monthly membership fees at the end of your free trial period and your membership will automatically renew monthly and recurring fees will be charged unless you cancel prior to the end of the free trial period. To view the specific details of your membership, including monthly membership price and end date of your free trial period, view your bank or credit card statement, monitor your email inbox, or email us at (support at schoolofliberty dot org) if you have specific questions. We may authorize your Payment Method for various lengths or terms or methods, including authorizing it up to approximately one month or six months of service as soon as you register. In some instances, your available balance or credit limit may be discounted to reflect the authorization during your free trial period. EMAIL US AT (SUPPORT AT SCHOOLOFLIBERTY DOT ORG) TO RECEIVE CANCELLATION INSTRUCTIONS. We will continue to bill your Payment Method on a monthly basis for your membership fee until you cancel. Billing Periodic Billing. By enrolling or starting your School of Liberty membership and providing or designating a Payment Method, you authorize us to charge you a monthly membership fee at the then current rate, and any other charges you may incur in connection with your use of the School of Liberty service, such as taxes or possible transaction fees, to your Payment Method. You acknowledge that the amount billed each month may vary from month to month for reasons that may include differing amounts due to promotional offers, and/or changing or adding a plan, and you authorize us to charge your Payment Method for such varying amounts, which may be billed monthly or every six months in one or more charges. Price Changes. We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Except as otherwise expressly provided for in these Terms, any price changes to your service will take effect after our email notice to you. Billing Cycle. The membership fee for access to our services and content will be billed at the beginning of the paying portion of your membership and each month thereafter unless and until you cancel your membership. As used in these Terms, "billing" shall indicate a charge, debit or other payment clearance, as applicable, against your Payment Method. Unless otherwise stated differently, month or monthly refers to your billing cycle. We plan to automatically bill your Payment Method each month on the calendar day nearest the day of commencement of your first paid membership. Membership fees are earned upon successful payment. We reserve the right to alter the cycle or timing of our billing, in particular, as indicated below, if your Payment Method has not successfully settled. In the event your paid membership began on the 29th, 30th, or 31st of a given month, we may bill your Payment Method in successive months on a day we deem appropriate. Your renewal date may also change due to changes in your Membership. We may authorize your Payment Method in anticipation of membership or service-related charges. No Refunds. PAYMENTS TO SCHOOL OF LIBERTY ARE NONREFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED PERIODS. Following any cancellation you may or may not immediately lose access to our members-area content, regardless of when your billing cycle began, renewed, or failed to renew. At any time, and for any reason, we may or may not provide a refund, discount, or other consideration to some or all of our members, as a courtesy at our discretion. We are not obligated us to provide credits, discounts, or refunds now or in the future, under any circumstance. Payment Methods. You may edit or alter or cancel your Payment Method information by emailing us at (support at schoolofliberty dot org) and clearly and unambiguously specifying your desire to cancel and close your account. If we close your account for any reason you may or may not be able to re-enroll using an updated or different payment method. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not edit your Payment Method information or cancel your account (see, "Cancellation" below), you remain responsible for any uncollected amounts and authorize us to continue billing the Payment Method, since it may be updated. This may result in a change to your payment billing dates. We may update your Payment Method with information provided by the applicable payment service provider, and you authorize us to continue to charge the membership fee to the updated Payment Method, including change of expiration date. We are not responsible for bank fees, foreign transaction fees, or other charges issued by your Payment Method provider. Check their terms for details. How to Cancel: Cancellation. You may cancel your School of Liberty membership at any time, but you will lose access to the School of Liberty subscription services at a time of our choosing. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL-MONTH MEMBERSHIP PERIODS OR UNWATCHED SCHOOL OF LIBERTY CONTENT. You may cancel your subscription or account by emailing us at (support at schoolofliberty dot org) and clearly and unambiguously specifying your desire to cancel and close your account. We will respond within a reasonable time. If you signed up for School of Liberty using your account with a third party as a Payment Method, and wish to cancel your School of Liberty membership at any time, including during your free trial, you may need to do so through such third party, including by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from, the School of Liberty service through that third party. You may also find billing information about your School of Liberty membership by visiting your account with the applicable third party. Copyright and DMCA: Copyright Infringement. We will investigate notices of copyright infringement and take appropriate actions under applicable local law including in the United States, the Digital Millennium Copyright Act. Written notification of claimed copyright infringement must be emailed to our DMCA Agent at (support at schoolofliberty dot org) or at the postal address below under the “Notice” clause below. To be effective, the notification must include the following: i. An electronic or physical signature of the copyright owner or the person authorized to act on its behalf; ii. A description of the copyrighted work claimed to have been infringed; iii. A description of the location of the infringing material and information reasonably sufficient to permit us to locate the material; iv. Your contact information, including your address, telephone number, and email address; v. A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and vi. A statement that the information in the notification is accurate, and, under the penalty of perjury, that you are authorized to act on behalf of the copyright owner. (This means that you are the owner, or you have written authorization from the copyright owner.) Please note that under Section 512(f) of the Copyright Act, any person who knowingly materially misrepresents that material or activity is infringing may be subject to large civil penalties and damages incurred by us, any copyright owner, or any copyright owner's licensee. You may also be subject to criminal prosecution for perjury. Please also note that the information provided in the above legal notice may be forwarded to the person who provided the allegedly infringing Submissions and we may choose to publish Claimant information in place of disabled Submissions. If you believe that someone has copied your work, either in part or whole, please follow our procedures. Counter Notice Under the DMCA. When we receive a notification of alleged copyright infringement, we remove the Submission that is the subject of the notification. If you believe your Submission was misidentified as infringing, you may file a counter-notification. If you did not have all of the rights to post the material at issue, you MUST NOT submit a counter-notification. Under Section 512(f) of the Copyright Act, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be liable for damages. If the original claim of alleged infringement was submitted under Section 512(c) of the Digital Millennium Copyright Act, you must use the DMCA counter-notification. The process for counter-notifications is governed by Section 512(g) of the Digital Millennium Copyright Act: http://www.copyright.gov/legislation/dmca.pdf. Accordingly, if you are not sure whether certain material infringes the copyrights of others, we suggest that you first contact an attorney. You must send the Counter Notice to our designated agent for receiving notices of infringement, whose name and contact information is under the DMCA notice above. A counter-notification must include the following specific elements: Identification of the specific URLs of material that our Site has removed or to which our Site has disabled access. Your full name, address, telephone number, and email address, and the username of your Account. The statement: “I consent to the jurisdiction of the Federal District Court in which the address is located, or if the user's address is outside of the United States, for any judicial district in which Company is located, and will accept service of process from the claimant.” The statement: “I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.” Signature. A scanned physical signature or a valid electronic signature will be accepted. Submission. We can only accept a counter-notification directly from the user from whose account Submission has been disabled. For verification, we require that Counter Notice be submitted from the email address associated with the account. Process: What happens next? After we receive your counter-notification, we will forward it to the party who submitted the original claim of copyright infringement. Please note that when we forward the counter-notification, it includes your personal information. By submitting a counter-notification, you consent to having your information revealed in this way. We will not forward the counter-notification to any party other than the original claimant. After we send out the counter-notification, the claimant must then notify us within 10 business days that he or she has filed an action seeking a court order to restrain you from engaging in infringing activity relating to the material on our Site. If we receive such notification we will be unable to restore the material. If we do not receive such notification, we may or may not reinstate the material, at our sole discretion.
